(a) For purposes of this Code, certain terms are defined as indicated herein. Any term not defined herein shall be as defined in the Village Zoning Code, or if not defined therein, as defined elsewhere in these Codified Ordinances, or if not defined elsewhere in these Codified Ordinances, as defined in Black's. Law Dictionary, or if not defined therein, as defined in Webster's New Collegiate Dictionary.
(b) All provisions of this Code are subject to the following rules of interpretation:
(1) The present tense includes the past and future tenses and the future tense includes the present tense.
(2) The singular number includes the plural and vice versa.
(3) The word "shall" is mandatory.
(4) The masculine gender includes the feminine and neuter.
(5) All measured quantities shall be to the nearest integral unit of measure, and if a fraction is one-half or greater, the next highest integral unit shall be used.
(6) The term "person" shall refer to any individual, firm, partnership, association, corporation, or organization of any kind.
(c) As used in this chapter:
(1) "Alteration" means the clearance, paving or improvement of a public or private site or public park, public right-of-way or other public area, or the erection, demolition, moving, enlargement or structural change of a structure thereupon, but excluding:
A. Routine maintenance and repair that does not, in the judgment of the Downtown Design Review Board, involve a significant change in use or appearance as viewed from a public area.
B. Any action required, in the judgment of Village, County and State building officials, for public safety because of immediate peril to life, health or property.
(2) "Reserved parking space" means any off-street parking space conspicuously marked as regularly reserved during business hours for the exclusive use of a specified individual, identified by name or job title or of the employees generally of a facility and that is not generally available for use by the facility's customers, clients or visitors.
(3) "Street furniture" means man-made objects, other than buildings, that are located on public streets or sidewalks, such as litter containers, planters, benches, public telephones and traffic signals and signs.
