935.08 SOLID WASTE HAULERS; PERMIT REQUIRED; VEHICLES; INSURANCE.
   (a)   No person shall engage in the business of collection or disposal of garbage or refuse of commercial establishments in the Village without first securing a permit from the Village and the County Health Department. The annual fee for the Village permit shall be fifty dollars ($50.00) for each vehicle used. Permits shall expire annually on December 31.
   (b)   An application for such permit shall be made to the Clerk-Treasurer and shall bereferred by the Clerk-Treasurer to Council. No permit shall be issued except on order of Council. All applications shall contain the following information:
      (1)   The name of the person making application;
      (2)   If a corporation, the names and addresses of all persons having an interest in excess of ten percent thereof;
      (3)   If a partnership, the names and addresses of any and all partners;
      (4)   The principal business address of each applicant;
      (5)   The telephone number of each applicant; and
      (6)   A rate schedule which shall remain in full force and effect during the period the permit shall be in force.
   (c)   Any vehicle used by a solid waste hauler shall be leakproof and equipped withtight covers for such portions as are used for the transportation of refuse. Garbage must be removed in packer-type truck bodies. Vehicles must be inspected annually by the Police Department.
   (d)   All dumpsters placed at commercial establishments must be periodically cleanedand disinfected by the solid waste hauler.
   (e)   Solid waste haulers must provide proof of dumping permits or contracts with either an approved landfill or transfer station.
   (f)   All applicants shall have in force at the time of application, and shall maintain in force for and during the term of the permit, a policy of insurance as follows:
      (1)   Liability insurance of not less than five hundred thousand dollars ($500,000) for each individual injured and not less than one million dollars ($1,000,000) for each occurrence; and
      (2)   Property damage insurance of not less than fifty thousand dollars ($50,000).
   (g)   All garbage and refuse removed from the Village must be disposed in a State EPA approved and licensed solid waste facility. The hauler must provide Council with proof of a permit or contract with such a facility.
   (h)   All persons holding permits hereunder shall fully and completely comply withany and all laws of the State, including, but not limited to, the workers' compensation and unemployment compensation laws.
