(a) Necessity. Council hereby determines and declares that it is necessary, for the preservation of the public peace, health, and safety, to provide more efficient and sanitary methods for the collection and disposal of garbage and refuse and to establish standards for the storage of garbage and refuse of residents.
(b) Franchise Required.No person, except a Village employee or a lawfully authorized franchisee, shall collect any garbage and refuse from the residents of the Village of Mount Gilead, Ohio.
(c) Exceptions. All commercial establishments in the Village shall subscribe to any trash, garbage, and rubbish collection service that is licensed by the County Health Department and by the Village. Commercial establishments may enter into private contracts with the contractor, but shall not be subscribers under the terms of the contract between the Village and the contractor or any Village service.
