(a) The Village reserves the right to deny, suspend or revoke a permit to discharge at the SRF.
(b) The Village reserves the right to back charge the users for costs incurred as the result of any of the violations herein described in a fashion similar to the cost recovery described in the Village of Mt. Gilead Sewer use Ordinance.
(c) It is intended that all SRF users follow the procedures described herein to ensure safety of users and of the Village plant operations and processes. If users do not follow the procedures described herein, they will be subject to the following fines and enforcement actions, and they may be barred from the use of the facility if such violations are repeated.
(d) Repeat violations or violations of more than one of the herein described Rules and Procedures by the same user will be treated more seriously by the Village.
(e) The number of violations by one user during the past 12-month period will be considered in the Village reaction to the new violation by any user.
(1) Normally, the first violation of any herein described Rules and Procedures by a user will result in any or all of the following: a phone call to discuss the problem, a written warning, and/or fine of up to two hundred dollars ($200.00) plus any costs that the Village may have incurred as a direct result of the violation.
(2) The second violation of any herein described Rules and Procedures by the same user in the past 12-month period will normally result in any or all of the following: notification of a mandatory hearing with the Village Administrator, a written warning, and/or a fine up to three hundred dollars ($300.00) plus any costs that the Village may have incurred as a direct result of the violation.
(3) The third violation of any herein described Rules and Procedures by the same user in the past 12-month period will normally result in any or all of the following: notification of a mandatory hearing with the Village Administrator, a written warning, and/or a fine up to five hundred dollars ($500.00) plus any costs that the Village may have incurred as a direct result of the violation, and/or a prohibition of any SRF discharge by the user or the firm for up to 12 months.
(4) Fines shall be billed to the corporation, firm or individual that the violating user represents.
(5) Suspension or denial of permits resulting from repeat violations may result in the prohibition of the driver and/or the entire firm from use of the SRF, depending on the circumstances.
(6) Critical violations affect drivers, firms and corporations directly. The HWDP may be denied or revoked even if the critical violation is made by a driver.
(7) Suspension or denial of permits resulting from a critical violation may cause a prohibition of use of the SRF by the driver, firm or corporation for a period of one year, several years, or permanently, depending on the circumstances.
(f) The Administrator will ratify suspension or denial of a permit resulting from a critical violation by signing the decision letter.
(g) Non-payment of fees in a timely fashion may result in denial of use of the SRF.
