(a) No owner or occupant of lots or lands abutting any sidewalk, curb or gutter shall fail to keep the sidewalks in repair and free from snow, ice or any nuisance, and to remove from such sidewalks all snow and ice accumulated thereon within a reasonable time, which will ordinarily not exceed 12 hours after any storm during which the snow and ice has accumulated.
(b) When a sidewalk has been damaged by some act of the Village, whether by Village personnel or agents, or by Village property (trees, etc.), the Village will assume the responsibility of repairing or replacing that portion of the sidewalk so damaged. In such instance, the portion damaged will be repaired or replaced by the Village, at its option, after informing the property owner. Generally, the damaged sidewalk must have risen or fallen over one inch and must be considered hazardous.
(c) If the property owner wishes to replace his or her portion also, then the following steps shall be taken:
(1) After consulting with the Village Administrator, the property owner shall secure a minimum of two estimates based on the linear foot, in regard to the amount of tree damage, and advise the Village Administrator. Sidewalks must be constructed in accordance with Section 907.01.
(2) The Village Administrator and the property owner will then determine the amount each will pay, subject to approval of the Village Council.
(3) When completed, the property owner will bill the Village for the amount the Village agreed to pay.
(4) The Village will then pay the property owner.
(d) A property owner, upon becoming aware of a damaged sidewalk, has an affirmative duty to notify the Village Administrator of its existence.
(e) Whoever violates this section is guilty of a minor misdemeanor or fine as determined by the Zoning Inspector.
