311.08 USE OF STREETS BY CONTRACTORS; MUD.
   (a)   Persons and contractors shall use care at construction or other sites within the Village to keep the surrounding area free of mud which could be carried on to Village streets, alleys or sidewalks by a vehicle or other means. If mud is carried on to the public streets, alleys or sidewalks from a site, the person or contractor responsible shall clean up the streets, alleys or sidewalks to the satisfaction of the Police Chief or the Street Commissioner. The designated Village official may also require a person or contractor to take specific steps to reduce mud at a given site.
   (b)   In addition to the penalty provided in Section 303.99, failure of a person or contractor to clean up mud on streets or alleys to the satisfaction of the designated official, or failure to take specific steps to reduce mud at a given site as directed by the designated official, shall be grounds for revocation of any or all permits issued by the Village.

   (c)   Whoever violates this section is guilty of a minor misdemeanor on the first offense. For each subsequent violation, such person is guilty of a misdemeanor of the fourth degree. A separate offense shall be deemed committed each day during or on which a violation occurs or continues. (A.O.)
