In the event that the Legislature of the State of Idaho, or the Congress of the United States or any Federal or State regulatory agency, shall take jurisdiction of the CATV business, the permit shall be totally subject to such enactment, and in the event a permit has been issued hereunder, the United States Congress, State Legislature or any other Federal or State regulatory agency makes compliance herewith impracticable, then in that event the permit holder may make application to the Council for relief under this Chapter; provided, however, that the performance bond shall remain in effect for the purpose of requiring the removal of all poles, towers, wires, cable and other such impediments on the streets and alleys within the City.
