(A) All outdoor swimming pools shall be made inaccessible when not in use by a non-climbable type of fence, wall or barrier. All openings or points of entry into the pool area enclosure shall be equipped with locking gates. The fence and gates shall be at least four feet in height and shall be constructed of a material approved by the Building Official. All fence posts shall be decay-resistant or corrosion-resistant and shall be set in concrete bases or other suitable protection. The opening between the bottom of the fence and the ground or other surface shall not be more than two inches.
(B) All gates shall be equipped with self-closing hinges and a self-latching device. Where the release mechanism of the self-latching device is located less than 54 inches from the bottom of the gate, the release mechanism shall be located on the pool side of the gate at least three inches below the top of the gate.
(C) All gates shall be equipped with a lock which will render the gate inaccessible when the pool is not in use. Ladders and steps shall be capable of being secured, locked or removed to prevent access. Ladders and steps which are non-removable or non-folding shall be surrounded by a barrier as stated in division (A) above. All locks shall be of the type that cannot be opened without the use of a key or numerical combination.
(D) No person owning or operating an outdoor swimming pool shall use, operate or allow the use of the swimming pool unless the pool complies with the above provisions. The required safety fencing shall be completely installed with installation of the pool.
