§ 50.016 PROHIBITING USES WITHIN THE WELLHEAD PROTECTION SANITARY SETBACK AREA.
   (A)   The construction of new sanitary or storm sewer lines within the sanitary setbacks of the wellhead protection area shall be prohibited.
   (B)   In the instance that the prohibition set forth in division (A) above cannot be met, a variance may be granted on the basis of the following conditions:
      (1)   The sewer pipe is installed more than 50 feet, as measured from all directions, from a public water supply system production well;
      (2)   The pipe is of water grade construction quality, in accordance with prevailing laws.
   (C)   Highways, interstates, county roads and any other roadway, driveway or parking surface shall be prohibited within the sanitary setback.
   (D)   A parking surface for well service vehicles shall be permitted if the area is owned and controlled by the town and restricted from access by the public.
