This chapter shall not be deemed to apply to sale of items of tangible personal property, goods or merchandise by a merchant in the ordinary course of his or her business while duly licensed and operating under proper zoning permit of the town and in compliance with requirements of other governmental authorities. This chapter shall apply however to any and all other sales of tangible personal property in the town on or within a tract of real estate used by any person for residential purposes; and such sales shill be referred to as "garage sale" or "garage sales" herein.
