§ 90.04 DISPOSAL; PUBLIC SALE.
   (A)   The public agency set forth and described under IC 9-22-1-3 to dispose of abandoned vehicles and to conduct such other functions as prescribed for the "Public Agency" under that section shall be the Town Clerk-Treasurer. The Clerk-Treasurer is further authorized to dispose of abandoned vehicles or parts thereof to the highest bidder at public sale after notice under IC 5-3-1, except only one newspaper insertion at least one week before the public sale is required.
   (B)   (1)   The abandoned vehicle or part thereof may be disposed of in accordance with IC 36-1-11, except that the 15-day period for the property to remain unclaimed is sufficient. The Clerk-Treasurer shall also give notice of such sale by first class mail to the last known address of the owner, if any, placing the same in the United States mail at least six days before the date of sale.
      (2)    At such sale, the Clerk-Treasurer may require that a minimum bid be equal to the removal and storage cost and cost of sale, if the Clerk-Treasurer reasonably deems that the value of the vehicle being disposed of is in excess of such costs. The Clerk-Treasurer may also set other terms of the sale.
