(A) Operator. Any person who operates a golf cart upon a county road shall be at least 16 years of age and shall have a valid Indiana driver's license and shall.
(B) Financial responsibility. Any person who operates a golf cart upon a county road shall have financial responsibility and provide proof of financial responsibility for said golf cart as defined above and in accordance with this chapter and the laws of the State of Indiana.
(C) Occupants. The number of occupants in a golf cart shall be limited to the number of persons for whom factory seating is installed and provided on the golf cart. The operator and all occupants shall be seated in the golf cart and no part of the body of the operator or any occupant shall extend outside the perimeter of the golf cart while the golf cart is being operated. No one under the age of eight years is allowed to ride on the back seat of the golf cart unless accompanied by an adult.
(D) Compliance with traffic laws and ordinances. All golf carts shall operate cautiously and courteously, and shall comply with all traffic laws and ordinances of the county and the State of Indiana.
(E) Permitted roads.
(1) Operation of golf carts is permitted on all county highways and county roads, subject to all local ordinances, state laws, state regulations, and all requirements contained in this chapter.
(2) The following county highways and county roads are exempt from this chapter and no golf cart shall be operated on or upon the following:
(a) Henderson Ford Road;
(b) Blue Bluff Road;
(c) Hadley Road;
(d) Mann Road;
(e) Greencastle Road;
(f) Landersdale Road;
(g) Baltimore Road; and
(h) Any county highway or county road that has a posted speed limit of 35 miles per hour (mph) or greater.
(F) Negligence prohibited. No person shall operate a golf cart in negligent or reckless manner so as to endanger the person or property of another or to cause injury or damage thereto.
