§ 113.03 TATTOO OPERATOR TRAINING RESPONSIBILITIES.
   An individual or entity that is a tattoo operator shall comply with the following training responsibilities:
   (A)   Ensure that the training described in the Indiana occupational safety and health administration’s bloodborne pathogens standard (as found in 29 C.F.R. § 1910.1030) is provided to all tattoo artists, anyone employed by the tattoo parlor, or anyone acting on behalf of the tattoo parlor who has a reasonably anticipated risk for skin, eye, mucous membrane or parenteral contact with blood or OPIM;
   (B)   Ensure that training on the handling of infectious waste is provided to all tattoo artists, anyone employed by the tattoo parlor, or anyone acting on behalf of the tattoo parlor who has a reasonably anticipated risk for skin, eye, mucous membrane or parenteral contact with blood or OPIM;
   (C)   Ensure that a record of training described in division (A) above is maintained, as required under the State Occupational Safety and Health Administration’s bloodborne pathogens standard (as found in 29 C.F.R. § 1910.1030) of an individual’s participation in the training that is provided. The record shall be made available to the Department for inspection upon request; and
   (D)   Ensure that a record of training described in division (B) above is maintained.
