(A) Definitions. For the purpose of this section, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
ADMINISTRATION BUILDING. Shall refer to the Morgan County Administration Building, located at 180 South Main Street, Martinsville, Morgan County, Indiana, 46151.
COURTHOUSE. Shall refer to the Morgan County Courthouse located at 10 East Washington Street, Martinsville, Morgan County, Indiana, 46151.
COURTHOUSE ANNEX. Shall refer to the Morgan County Courthouse Annex located at 65 North Jefferson Street, Martinsville, Morgan County, Indiana, 46151.
FIREARM. Shall be as defined by I.C. 35-47-1-5.
WEAPON. Includes, but is not limited to, any of the following:
(a) “Deadly weapon” as defined by I.C. 35-31.5-2-86;
(b) “Electric stun weapon” as defined by I.C. 35-47-8-1;
(c) “Stun gun” as defined by I.C. 35-47-8-2;
(d) “Taser” as defined by Indiana Code § 35-47-8-3;
(e) “Knife”;
(f) “Explosive” refers to any agent or substance tending or serving to explode. EXPLOSIVE shall include, but be not limited to, gunpowder and dynamite;
(g) “Club”; and/or
(h) Any other object that in the manner in which it is used, or could ordinarily be used, or is intended to be used, is readily capable of causing serious bodily injury (as defined by I.C. 35-31.5-2-86).
(B) Restrictions. Except as provided in division (C) below, a person shall not possess on or about his or her person a weapon within the County Courthouse, the Administration Building or the Courthouse Annex. Except as provided in division (C) below, a person shall not possess on or about his or her person a firearm within the County Courthouse. A person may not intentionally display a firearm at a public meeting located upon any property owned by Morgan County, including the Courthouse, Administration Building and Courthouse Annex.
(C) Exceptions.
(1) The following persons who are in the Courthouse, Administration Building or Courthouse Annex for official business and duly authorized to carry weapons or firearms are exempt from application of this section:
(a) Law enforcement officers, as defined under I.C. 35-31.5-2-185;
(b) State Department of Correction officers;
(c) Community correction officers;
(d) Judicial officers; and
(e) Probation officers.
(2) Possession of a chemical spray device used for personal protection by a county employee working within the Courthouse, Administration Building or Courthouse Annex is exempt from application of this section.
(3) The above exemptions shall not apply to any person who is otherwise exempt if they are appearing, or accompanying a family member who is appearing before any court located in the Courthouse, Administration Building or Courthouse Annex for any proceedings unless they are appearing in their official capacity or as a result of their employment.
(D) Enforcement. Any violation of this section may be enforced by the County Prosecutor or the County Attorney in a proceeding before the Board of Commissioners of the county or as a civil proceeding before any Superior Court or Circuit Court of the county.
