(A) Any person, partnership, company, corporation, association or agency intending to construct or improve an entrance, driveway or approach subject to this subchapter shall make written application to the Morgan County Highway Department (the "Department") and secure a permit from the Department prior to commencing construction or improvement of the entrance, driveway or approach. A permit must be issued under this subchapter prior to construction or improvement of an entrance, driveway or approach located within the right-of-way of Morgan County.
(B) The Department shall develop and prepare forms and permits in compliance with this subchapter. The permit shall identify the parcel of real estate seeking access to the county road, identify the name, address, telephone number of the parcel owner and provide other such information deemed necessary by the Department.
(C) A valid driveway permit shall be obtained prior to the issuance of any improvement location permit or building permit, unless the construction or improvement of an entrance, driveway or approach is not necessary.
