(A) It shall be unlawful for any person or persons to operate or use any motor vehicle, auto-mobile, motorcycle, all-terrain vehicle, dirt bike, go-cart, recreational vehicle or any other vehicle, as follows:
(1) In a condition of disrepair or so loaded or operated as to produce or generate unreasonably loud, disturbing or unnecessary noise;
(2) Without a functioning muffler/exhaust system or other noise control equipment; or
(3) With the muffler/exhaust system or noise control equipment altered, modified, removed or maintained in such a condition of disrepair as to generate or produce unreasonably loud, disturbing or unnecessary noise.
(B) Notwithstanding the above, it shall be unlawful for any person or persons to operate or use any motor vehicle, automobile, motorcycle, all-terrain vehicle, dirt bike, go-cart, recreational vehicle or any other vehicle which produces or generates unreasonably loud, disturbing or unnecessary noise between the hours of 9:00 p.m. through 7:00 a.m., where five or more residences are located within 750 feet of the tract, parcel or lot upon which the vehicle is operated or used.
