The owner shall confine and restrain any dog known to be dangerous or vicious or which has previously attacked or bitten a person or harassed livestock, and such dog must be kept in a confined area reasonably designed to prevent contact with individuals or firmly tied in such a manner as to prevent such animal’s escape. In event of escape, the owner shall be subject to penalties under this chapter; and, if such dog is impounded, it need not be returned to its owner, but may be destroyed as provided herein.
