§ 35.60 ADJUSTED GROSS INCOME TAX.
   (A)   Adjusted gross income tax rate to fund property tax replacement amounts.
      (1)   (a)   The county hereby imposes an additional county adjusted income tax rate to raise income tax revenue to provide the replacement amount.
         (b)   Based upon calculations provided to the county by the Department of Local Government Finance, the Year 1 Rate imposed in the county from October 1 of the year in which it is imposed through September 30 of the following year is 0.20%.
         (c)   Based upon calculations provided to the county by the Department of Local Government Finance, the Replacement Rate imposed in the county from October 1 of the year following year through September 30 of the year after the following year is 0.20%.
         (d)   The replacement rate may not otherwise be decreased or rescinded.
      (2)   The rate imposed by this section is in addition to any other tax rates imposed under state law and does not affect the purposes for which other tax revenue may be used.
      (3)   This section takes effect October 1, 2007.
      (4)   The County Auditor shall provide a certified copy of this section to the Department of Revenue and the Department of Local Government Finance by certified mail.
   (B)   Adjusted gross income tax to provide property tax relief. The county adjusted gross income tax rate shall be increased as follows.
      (1)   The county hereby imposes an additional county adjusted gross income tax rate of 1% to raise income tax revenue to provide property tax relief to political subdivisions in the county.
      (2)   Property tax relief shall take the form designated by the Council
      (3)   The rate imposed by this section is in addition to any other tax rates imposed under state law and does not affect the purposes for which other tax revenue may be used.
      (4)   This section shall take effect on October 1, 2007.
      (5)   The County Auditor shall provide a certified copy of this section to the Department of Revenue and the Department of Local Government Finance by certified mail.
   (C)   Imposing an additional rate of the county adjusted gross income tax to fund public safety costs. The county adjusted gross income tax rate shall be increased as follows.
      (1)   The county hereby imposes an additional rate of the county adjusted gross income tax at the rate of 0.25% to provide funding for public safety in the county (“Public Safety Rate”).
      (2)   The County Auditor shall distribute income tax revenues attributable to the public safety rate to the county and to each municipality in the county. The amount distributed to the county or
municipality is equal to the result of the portion of the income tax revenues attributable the public safety rate; multiplied by a fraction equal to:
         (a)   The attributed allocation amount of the county or municipality for the calendar year; divided by
         (b)   The sum of the attributed allocation amounts of the county and each municipality in the county for the calendar year.
      (3)   The rate imposed by this section is in addition to any other tax rates imposed under state law and does not affect the purposes for which other tax revenue may be used.
      (4)   This section shall take effect on October 1, 2007.
      (5)   The County Auditor shall send a certified copy of this section to the Department of State Revenue and the Department of Local Government Finance by certified mail.
