§ 35.37 FEES CHARGED BY RECORDER.
   The County Recorder may authorize the purchase of photostatic copies of official records at the Recorder’s Office directly from any processor or developer who may be processing and developing photostatic copies of the official records of the County Recorder’s Office pursuant to an agreement or contract with the Recorder, upon the following basis.
   (A)   Any individual desiring to purchase copies of such records directly from the supplier or developer shall first obtain the authority of the County Recorder and sign an agreement that purchaser will not sell film or copies to other companies or sales agents, and that microfilm purchased will be only for use in title work with their specific company and client. The cost per frame is $0.03, payable to the County Recorder.
   (B)   Upon such payment, the Recorder shall notify the processor or developer and they may release and sell to such individual photostatic copies as they may desire, or the Recorder has the option of having said copies sent to them to be distributed; provided, however, it is covered by the payments aforesaid.
   (C)   This does not prevent the processor or developer from charging additional sums which he or she may find reasonable to cover his or her expenses and costs of supplying copies to such person, nor does it prevent the Recorder from charging additional sums they find reasonable to cover processing such as shipping and processing/developing if it is sent to the Recorder to be distributed.
   (D)   It should be unlawful for any processor or developer doing business with or contracting with the county for such processing or photostatic copies or official documents held by the Recorder of the county to sell or furnish copies of such documents before first receiving authority from the County Recorder.
   (E)   The County Recorder shall further charge the sum of $2 per copy for copies of all other records furnished by the Recorder’s Office which are 18 inches by 24 inches or larger.
   (F)   The County Recorder shall furnish computer generated reports to persons making a written request to include type of report and dates of report, at a charge of $0.25 per computer page (eight and one-half inches by 11 inches) for reports of 20 pages or more. Reports of 19 pages or less will be charged the cost of $1 per page as set out by the State Board of Accounts.
   (G)   The revenue generated by such fees shall be paid to the County Recorder and used in accordance with I.C. 32-2-7-10 and be deposited into the Recorder’s Perpetuation Fund.
