§ 35.09 “IT’S YOUR CHOICE” PROGRAM; FUND AND FEES.
   (A)   The “It’s Your Choice” Fund is hereby established and shall be implemented as follows.
      (1)   All fees received by the County Sheriff’s Department in conjunction with the “It’s Your Choice” program shall be deposited with the County Treasurer and accounted for by the County Auditor.
      (2)   All payments shall be made from such fund by manner of claim by the County Sheriff’s Department for the payment of the expenses of the program.
      (3)   The funds deposited in the fund shall be subject to appropriation by the County Council, the fiscal body of the county.
   (B)   The County Sheriff’s Department shall collect fees for the administration and expenses of the “It’s Your Choice” program, but the fees shall be set as follows:
      (1)   PHASE I, a four-hour program: $20 fee for the county residents, $40 fee for nonresidents;
      (2)   PHASE II, a seven-hour program: $25 fee for the county residents, $50 for nonresidents; and
      (3)   PHASE III, a three-day program: $200 for the county residents, $300 for nonresidents.
