(a) No person, whether as owner, lessee, tenant, occupant, agent or any other person having charge or in control of any lot in the Village shall allow or permit noxious weeds, grasses, vines or any other ground cover to exceed a height of six inches or to spread the mature seeds thereon, or fail to cut and destroy such noxious weeds, grasses, vines or other ground cover when ordered to do so by the Building Inspector. For purposes of this section, “noxious weeds” is defined as any plant type or species designated a prohibited noxious weed by the Director of Agriculture.
(b) The Building Inspector shall issue written notice of a violation of subsection (a) hereof to the owner, lessee, tenant, occupant, agent or any other person having charge or in control of such lot in the Village. The notice shall state that the violation must be corrected within five days after receipt of notice.
(c) If a violation of subsection (a) hereof is not corrected within five days after receipt of notice, the Building Inspector shall cause the violation to be corrected and shall give notice to the owner of such lot by certified mail at his/her tax mailing address of the cost incurred. If such cost is not paid within thirty days after receipt of such notice, a collection fee of seventy dollars ($70.00) will be added to the cost thereto, and such amount shall be certified by the Village Treasurer to the County Auditor for collection in the same manner as other taxes and assessments are collected.
(d) Whoever violates any provision of this chapter shall be guilty of a misdemeanor of the first degree. Each day that a violation occurs or continues shall be deemed a separate offense. (Ord. 2012-11. Passed 3-14-12.)
