521.12 OUTDOOR FIRES.
   (a)   No person shall start or maintain any fire in the open air upon any property within the Village except pursuant to and under the conditions of a permit issued by the Police Chief.
 
   (b)   Upon application, the Police Chief may issue a permit for starting or maintaining a fire in the open air provided the Police Chief determines that the fire can be started and maintained without danger of injury or damage to persons or property. The Police Chief may prescribe conditions in the permit as in his judgment are necessary to adequately protect persons and property. Such permit shall be conditioned upon the applicant’s agreement to indemnify and hold harmless the Municipality for all costs and liability which may be incurred as a result of the fire. If any police officer determines that because of weather or other conditions an open fire for which a permit has been issued cannot be safely started or maintained, the police officer may order the open fire not be started or that it be extinguished. Any such order may be reversed only by the Police Chief.
 
   (c)   Whoever violates this section is guilty of a misdemeanor of the first degree.
