339.02 USE OF LOCAL STREETS; LOCAL PERMIT AND CONDITIONS.
   (a)   Use of Local Streets. The streets within the Municipality other than SOM Center Road (SR 91) and South Woodland Road (SR 87) shall be prohibited to trucks or any combination of commercial tractors with a trailer or semi-trailer, except that such commercial vehicles may use a restricted street when necessary for the purpose of receiving or delivering goods and/or providing service to the Municipality or its residents in the immediate neighborhood of such restricted street, in which instance the commercial vehicle shall enter and leave such restricted street by the nearest designated thoroughfare.
   Streets within the Municipality other than SOM Center Road (SR 91) and South Woodland Drive (SR 87) shall be further restricted in that no truck with a gross vehicle weight in excess of 36,000 pounds shall be permitted except as provided in subsections (b) and (c) hereafter.
   
   (b)   Exceptions to Limits. The prohibitions on through truck traffic contained herein shall be and are applicable to all trucks, resident and nonresident, through and local, in the same manner and to the same extent, except as set forth hereinafter. The following trucks are specifically excluded from the provisions of this section: school buses, municipal safety, emergency, and Service Department vehicles; trucks owned and operated by municipalities having a mutual aid agreement with the Municipality of Moreland Hills in effect; trucks equal to or less than 8,000 pounds total gross vehicle weight, such as single-axle trucks, delivery trucks, vans or all-purpose pick-up trucks.

   (c)   Local Permit and Conditions. Upon applications and for good cause, the Police Chief may issue a local permit authorizing an applicant to move an oversize or overweight vehicle or combination of vehicles upon local streets.
   The Police Chief may grant a permit for a single or round trip, or for such period of time, not to exceed one year, as duration of any construction project. The Police Chief may limit or prescribe terms or conditions of operation for such vehicle or combination of vehicles by designating the route, hours, speed or such other restrictions as may be necessary for the preservation of the public peace, property, health and safety. The Police Chief may require the posting of bond or other security necessary to compensate for any damages to a roadway or road structure.
   For each such permit, the Police Chief shall charge five dollars ($5.00), and for each hour of time or any part thereof spent by the Police Department in supervising the movement of such vehicle, the applicant shall pay the sum of ten dollars ($10.00).
   Violation of any of the limitations, terms or conditions of the permit granted by the Police Chief shall be cause for immediate revocation or suspension of such permit, and denial of request for any future permits. Such violation shall also subject the violator to the penalty prescribed by Section 303.99.
   Signs may be posted indicating “NO THRU TRUCKS” and “NO THRU TRAFFIC”, as appropriate, to apprise drivers of the limitations imposed by this section. No driver shall disobey the instructions indicated on any such sign.
   The Police Chief upon recommendation of the Municipal Engineer may limit the maximum weight of a vehicle for a particular road to less than twenty tons.

   (d)   Whoever violates this section is guilty of a minor misdemeanor on a first offense; on a second offense within one year after the first offense, the person is guilty of a misdemeanor of the fourth degree; on each subsequent offense within one year after the first offense, the person is guilty of a misdemeanor of the third degree.
