1343.06 UNOCCUPIED DWELLINGS WITH SEPTIC SYSTEMS.   
   (a)    The owner of a dwelling to be sold, transferred or conveyed in a manner requiring a point-of-sale inspection by this Chapter, that has been unoccupied for a period of thirty (30) days or more prior to the date of transfer and with a septic system and/or private water system on the premises that cannot be properly evaluated, as determined by the CCGHD, shall indicate such unoccupied status of the dwelling on the application.
 
   (b)   An Initial Certificate of Inspection for a dwelling described in subsection (a) shall contain the following statement:
 
UNOCCUPIED DWELLING WITH SEPTIC SYSTEM AND/OR
PRIVATE WATER SYSTEM STATEMENT
         A SEPTIC SYSTEM AND/OR PRIVATE WATER SYSTEM IS LOCATED ON THE PREMISES. CHAPTER 1343 OF THE CODIFIED ORDINANCE OF THE VILLAGE OF MORELAND HILLS REQUIRES THE SEPTIC SYSTEM AND PRIVATE WATER SYSTEM TO BE INSPECTED BY THE CUYAHOGA COUNTY GENERAL HEALTH DISTRICT ("CCGHD") TO DETERMINE COMPLIANCE WITH THE CCGHD'S HOUSEHOLD SEWAGE TREATMENT SYSTEM AND PRIVATE WATER SYSTEM REQUIREMENTS. THE CCGHD IS UNABLE TO PROPERLY INSPECT AND TEST THE SEPTIC SYSTEM AND PRIVATE WATER SYSTEM AS THE DWELLING HAS BEEN UNOCCUPIED FOR A PERIOD OF MORE THAN THIRTY (30) DAYS.
         WHEN THE DWELLING HAS BEEN OCCUPIED FOR MORE THAN THIRTY (30) DAYS, THE OWNER OF THE PROPERTY IS REQUIRED TO CONTACT THE CCGHD AND MAKE ARRANGEMENTS FOR THE NECESSARY INSPECTION. THE RESULTS OF SUCH INSPECTION SHALL BE FORWARDED TO THE VILLAGE BUILDING COMMISSIONER.
         THE OWNER IS REQUIRED TO COMPLY WITH ANY ORDERS FOR CORRECTION ISSUED BY THE CCGHD WITHIN THE TIME FRAME ESTABLISHED BY THE CCGHD AND TO REQUEST A CERTIFICATE OF COMPLIANCE FROM THE BUILDING INSPECTOR. FAILURE TO DO SO IS A VIOLATION OF CHAPTER 1343 AND MAY SUBJECT THE OWNER TO CIVIL AND CRIMINAL PENALTIES.
 
 
   (c)   Upon sale, transfer, or conveyance of a dwelling described in subsection (a), the owner shall submit an application to the Building Commissioner for a Certificate of Inspection within thirty (30) days after the date of sale or transfer. There shall be no fee for such application. The Building Commissioner shall forward the application to the CCGHD. The CCGHD will inspect the septic system and/or private water system in accordance with its requirements and advise the Building Commissioner if the septic system is in compliance with CCGHD household sewage treatment system and private water system requirements. The CCGHD will issue Orders for Correction for any premises not in compliance with CCGHD household sewage treatment system or private water system requirements. Orders for Correction issued by the CCGHD for household sewage treatment system or private water system requirement violations shall be corrected to the satisfaction of the CCGHD and within the time frame established by the CCGHD.
