937.07 APPEALS FROM THE DECISION OF THE VILLAGE ENGINEER.
   (a)   Any interested person, within ten (10) days of receiving a decision from the Village Engineer, or such other time as may be established, may file a notice of appeal with the Village Engineer and the Clerk of Council. The Planning Commission, serving as the Board of Appeals, shall hear the appeal within sixty (60) days and shall decide the matter within one hundred twenty (120) days of the date the notice of appeal is filed unless the parties agree to an extension of time.
   (b)   All meetings of the Board of Appeals shall be open to the public, and the Board of Appeals shall designate one of its members to act as Secretary or may request that the Clerk of Council perform such service. The Board of Appeals may adopt such rules and regulations as it deems proper and just for the orderly performance of its functions. The Board of Appeals, at its discretion, may retain independent experts to assist it with any appeal matter before the Board.
   (c)   The Board of Appeals shall have the authority to affirm, modify, or, upon a finding that an interpretation made by the Village Engineer is clearly erroneous, reverse an interpretation of the Village Engineer.
   (d)   The decision of the Board of Appeals shall be deemed final upon the mailing of the decision to all parties. Any interested party, including the Village, may appeal the decision of the Board of Appeals in the manner provided by law.
