933.04 USE OF FIRE HYDRANTS FOR NON-FIRE PURPOSES.
   (a)   No person shall use any fire hydrant in the Village for construction or other non-fire purposes without first obtaining a permit for such use from the Village.
   (b)   Prior to receiving a permit from the Village, the applicant shall obtain written permission from the Fire Chief and the City of Cleveland Division of Water and/or the Chagrin Falls Water Department, as applicable.
   (c)   Prior to receiving a permit from the Village, the applicant shall pay to the Village a damage deposit in the amount of one thousand dollars ($1,000). At the conclusion of use, the applicant shall notify the Village, and the Service Director shall inspect the fire hydrant. The Service Director shall repair any damages to the hydrant and deduct all costs for such repairs from the one thousand dollar ($1,000) deposit. Any costs in excess of one thousand dollars ($1,000) shall be reimbursed to the Village by the applicant. In the event there is no hydrant damage or the damages do not exceed one thousand dollars ($1,000), the deposit or remaining balance thereof, as applicable, shall then be refunded the applicant.
   (d)   Prior to issuing a permit, the Village shall collect from the applicant a non- refundable administrative and inspection fee in the amount of twenty-five dollars ($25.00).
   (e)   Upon issuance of the permit, the applicant shall be responsible for any and all damage caused by or resulting from such use.
   (f)   If the hose or water run-off will affect traffic or safety on public streets or sidewalks, the hydrant user shall notify the Village Police Department prior to commencing such use.
   (g)   All hydrants used for non-fire purposes shall have reducing couplings attached to the nozzles of the hydrants, with an independent valve for regulating the water supply.
   (h)   The main valve of the hydrant shall be opened full at the beginning of each work day and shall remain open until the conclusion of work at the end of the work day. The water supply shall be regulated by the independent valve. The hydrant shall be operated only by a proper hydrant key.
   (i)   Water must not run except when being used. No leaking hose, pipe or joints shall be permitted. All persons using hydrants shall obey any instructions or orders issued by (1) Village officials and (2) the Cleveland Department of Public Utilities and/or the Chagrin Falls Water Department, as applicable, regarding the use of the hydrants.
   (j)   If the hydrant user fails to comply with the requirements of this section, the water supply shall be stopped immediately. The hydrant permit shall be revoked and no new permit for the use of any hydrant shall be issued until all resulting damage or charges have been paid.
   (k)   If required by the Cleveland Department of Public Utilities, or the Chagrin Falls Water Department, a meter shall be applied to the connection made with the hydrant, at the expense of the party using the hydrant, and that party shall pay for all water by water meter measure.
