CHAPTER 95: PARK REGULATIONS

§ 95.01 HOURS OF OPERATION.
   (A)   The Don Greenhill City Park, including all baseball fields, skate park and picnic area, shall be opened to the public daily from 6:00 a.m. to 11:00 p.m., except for recreational sporting events approved by the City of Morehead Director of Recreation. The shelter areas shall be opened to the public during said times so long as said shelters have not been reserved for private use.
   (B)   Peggie's Place shall be opened to public use by reservation only during the hours of 8:00 a.m. to 11:00 p.m.
   (C)   Rodburn Hollow Park shall be opened to the public daily from 6:00 a.m. to 9:00 p.m. during the months of March through October and 6:00 a.m. to 6:00 p.m. during the months of November through February. The shelters in said Park shall be opened to the public and for private use by reservation during said times.

§ 95.02 DOG PARK (MOREHEAD BARK PARK).
   (A)   No dangerous dog shall be permitted to enter upon or into the Dog Park. A dangerous animal is defined as follows:
      (1)   Any dog that has attacked or bitten without provocation a person engaged in a lawful activity within the city;
      (2)   Any dog that has killed or injured another dog after the owner thereof has been given written or verbal notice by authorities to keep the dog confined or muzzled; or
      (3)   Any dog that has been declared to be dangerous by a physician attending a person who has been bitten or attacked by such dog.
   (B)   It shall be unlawful for any person or person to utilize the dog park located in Don Greenhill City Park in a manner which violates the following rules:
      (1)   Any persons entering the dog park acknowledge the risks and a possible danger associated with dog parks, and assumes the risk of injury to themselves and their dogs.
      (2)   The hours of operations of the dog park shall be those of Don Greenhill Park.
      (3)   The dog park is for use of dogs and handlers only. No other animals are permitted in the dog park.
      (4)   Any dog utilizing the dog park shall display a current rabies tag.
      (5)   Any dog utilizing the dog park shall display an owner identification tag.
      (6)   Dogs must be leashed when entering and exiting the dog park.
      (7)   Only dogs older than four (4) months of age may enter the dog park.
      (8)   Only dogs current on required vaccinations may enter the dog park.
      (9)   Female dogs in heat are prohibited from entering the dog park.
      (10)   Children under the age of thirteen (13) years may not enter the dog park unless accompanied by an adult.
      (11)   Dog owners or handlers must be inside the dog park, be within view of their dog(s) and have on their person a non-retractable leash no longer than six (6) feet.
      (12)   Dogs outside of the dog park enclosure must be on a leash. No dogs shall be permitted to run at large outside of the dog park.
      (13)   Choke, prong, pinch and spike collars are not permitted within the dog park.
      (14)   Dogs displaying aggressive behaviors are not permitted within the dog park.
      (15)   Squeaky toys are not permitted with the dog park.
      (16)   Dog owners or handlers shall pick-up, seal and properly remove their dog's waste.
      (17)   Dog owners or handlers must fill in any holes their dog digs.
      (18)   Food, long-lasting dog chews and glass containers are not permitted in the dog park.
      (19)   No person shall bring into or consume any food with the dog park.
      (20)   No more than three (3) dogs per person.
      (21)   Dog trainers are not permitted to use the dog park to conduct business.
      (22)   Do not brush or otherwise groom dogs inside the park. Pet grooming often produces loose hair which can soil the dog park.
   (C)   Dog owners or handlers that fail to comply with these rules may be asked to leave by Recreation Personnel or Law Enforcement Officers.
   (D)   The dog park shall be closed and no dog shall be permitted in the dog park when city personnel are conducting maintenance. No animals shall be permitted with the picnic areas, play areas of the parks or at sporting events held at the parks.

§ 95.03 PROHIBITION AGAINST WATER SPORTS IN OR ON TRIPLETT CREEK.
   (A)   No swimming or other water contact team sports shall be permitted in or on Triplett Creek at any point within the city.
   (B)   Any person violating this section shall be guilty of a misdemeanor, and upon conviction, fined not less than ten dollars ($10.00) nor more than five hundred dollars ($500.00) for each offense.

§ 95.04 ALCOHOLIC BEVERAGES.
   Except for (i) the sale and consumption of alcoholic beverages in conjunction with a city-sponsored event as authorized in writing by the city or (ii) the sale and consumption of alcoholic beverages in conjunction with the rental of Peggie's Place in accordance with the rental agreement signed by the parties and proper license to sell, no person shall sell or consume any alcoholic beverages within the city park.
