(A) It shall be unlawful for any person, corporation or other legal entity to keep or maintain any one or more of the following within the corporate limits of the town: Horse; mule; pony; goat; sheep; pig; potbellied pig; hog; chicken or rooster; turkey; duck; goose; pigeon; cow or cattle; more than two rabbits; or other farm animals that are inconsistent with residential uses in an area not zoned for agricultural use.
(B) It shall be deemed a violation of this section to display any type of exotic animal, reptile or wild animal in a public place without first obtaining approval through the Town Council. Pet shop displays would be excluded from this section. The granting of the approval shall be based upon public health and safety.
(C) It shall be deemed a violation of this section to stake any animal outside when it is in heat; any such animal must be maintained in an enclosed building or structure which restricts it from leaving and other animals from entering or in a fenced area that restricts the animal from leaving the property or any other animals from entering the property.
(D) It shall not be permissible to give away any type of animal as a prize without first obtaining approval of the Town Council to ensure the public’s safety from any health hazards.
(E) Any animal requiring a statewide animal possession permit must file with the Clerk-Treasurer a notice of the permit, a description of the animal, the animal’s location and copies of the permit application which would show the details, including appropriate immunization, the plan for quick and safe recapture and other details relevant to the public health and safety for the town.
(F) This section shall be enforced through the town’s animal control officer or the Town Marshal’s office with all violations being cited into the Town Court.
