7-1-4: IMPOUNDMENT OF VEHICLES:
   A.   Authority To Impound: In addition to the authority granted in 47 Oklahoma Statutes, members of the Police Department are hereby authorized to remove a vehicle from a street to a garage or other place of safety under any of the circumstances hereinafter enumerated:
      1.   When any vehicle is left unattended upon any bridge, viaduct, or causeway, or in any tube or tunnel where such vehicle constitutes an obstruction to traffic.
      2.   When a vehicle upon a street is so disabled as to constitute an obstruction to traffic, and the person or persons in charge of the vehicle are, by reason of physical injury or otherwise, incapacitated to such an extent as to be unable to provide for its custody or removal.
      3.   When any vehicle is left unattended upon a street and is so parked illegally as to constitute a definite hazard or obstruction to the normal movement of traffic.
      4.   When any vehicle has been parked for more than one (1) hour in excess of the time allowed for parking in any place.
      5.   When any vehicle which has been involved in two (2) or more violations of this title for which citation tags have been issued and not presented as required, is parked in violation of any provision of this title.
      6.   When any vehicle is in violation of title 5, chapter 4 of this Code.
      7.   When any vehicle which is in violation of section 7-3-1 of this title or section 8-1-2 of this Code following proper notification.
   B.   Release Of Vehicle: A vehicle impounded as provided herein shall be delivered back to the owner or other person to whom it may properly be delivered only after such fine or fines and costs as may be properly assessed by the Municipal Judge for the violation or violations for which such vehicle was impounded and any reasonable costs or charges for impounding and storage shall have been paid.    C.   Impound And Storage Fees:
      1.   When a vehicle is impounded as provided herein, the Town may assess an impound fee in the amount as provided in the fee schedule adopted by resolution of the Town Board of Trustees. Said impound fee shall be paid in full prior to the release of the vehicle from the Town impound lot.
      2.   When a vehicle is impounded as provided herein and stored on Town property, the Town shall assess a storage rate in the amount as provided in the fee schedule adopted by resolution of the Town Board of Trustees. Any portion of a day which the impounded vehicle is stored on Town property shall constitute a full day for calculation of the total storage fee. Said storage fee shall be paid in full prior to the release of the vehicle from the Town impound lot. (Ord. 324, 8-8-2016; amd. 2017 Code)
