§ 111.06 STATE LAWS ADOPTED.
   All applicable statutes, rules and regulations of the state controlling, limiting or qualifying the licensing, use, distribution or sale of beer, wine or other alcoholic beverages is adopted by the city, subject to such additional prohibited acts or conduct as may be adopted by the city.

§ 111.07 HOURS FOR ON-PREMISES CONSUMPTION.
   No person shall remain on any licensed premises for on-premises consumption of beer, wine or other alcoholic beverages more than 30 minutes after the time for lawful distribution or sale of beer, wine and other alcoholic beverages has expired, except for owners, managers or employees who are reasonably required to clean up and close the premises.

§ 111.08 LIQUOR BY THE DRINK; SALE, DISTRIBUTION AND CONSUMPTION.
   Liquor by the drink may be sold, offered for sale or given away upon any licensed premises, unless otherwise prohibited by law, during the following hours:
   (A)   On any Sunday, not otherwise prohibited by law, between the hours of 11:00 a.m. and 12:00 a.m.;
   (B)   On Memorial day, not otherwise prohibited by law; and
   (C)   On any Friday and Saturday, not otherwise prohibited by law, between the hours of 10:00 a.m. and 2:00 a.m. of the following day.

§ 111.09 UNSEALED OR OPENED CONTAINERS.
   (A)   No person shall consume or have in his or her possession any unsealed or opened container of beer, wine or other alcoholic beverages while operating or riding in a motor vehicle upon any street or premises open to the general public in the city.
   (B)   No person shall consume or have in his or her possession any unsealed or opened container of beer, wine or other alcoholic beverages on any sidewalks, public facilities, public parks, building or premises open to the general public in the city, unless the premises has a license for on-premises consumption of beer, wine and other alcoholic beverages.

§ 111.10 APPLICATION FOR SPECIAL PERMIT.
   (A)   Upon written application, the Mayor may grant a special permit for the consumption of beer, wine or other alcoholic beverages on specific public facilities.
   (B)   The application shall identify the public premises or facilities, the time, the persons consuming beer, wine or other alcoholic beverages and the persons responsible to the city.

§ 111.99 PENALTY.
   (A)   Any person violating this chapter shall be guilty of a misdemeanor for each day said person shall remain in violation of this chapter.

   (B)   Any person or entity who violates any provision of § 111.08 shall be guilty of a misdemeanor and, upon conviction of the same, shall be punished as set forth in Idaho Code § 18-113, or if said code has been repealed, the maximum punishment shall be confinement in jail for a period not to exceed six months and/or a fine of $1,000.
