(A) Commission appointed and terms of office.
(1) (a) There is created a Commission to be known and designated as the City Golf Course Commission, which Commission shall consist of five members to be appointed by the Mayor with the consent of the Council, one of whom must be a member of the Council and the other four may or may not be members of the Council, with a simple majority of the Commission being residents within the city.
(b) On the taking effect of this section, the Mayor, with the consent and approval of the Council, shall appoint a member from the Council to serve for a period of three years or until the end of the elective term of said member of said Council, two members to serve for a period of two years, one member for a period of three years and one member for a period of four years.
(2) Thereafter, as the term of each member of said Commission expires, except for the member from the Council whose appointment shall never exceed the term to which elected as a Council member, the Mayor shall appoint a Commissioner for a term of four years. Any Commissioner may be discharged from office at any time upon request of the Mayor and by vote of the Council. Any vacancy in the membership of the Commission shall be filled by appointment by the Mayor and/or the consent of the Council, which appointee shall hold office until the expiration of the term to which he or she was appointed.
(B) Organization and meetings.
(1) The Golf Course Commission (herein Commission) shall meet as often as deemed appropriate to fulfill the duties prescribed herein, providing the Commission shall meet not less than twice annually.
(2) The Commission may organize and conduct its meetings in such manner as the Commission deems appropriate, providing that topical minutes of all meetings shall be kept and any recommendations to the city be reduced to writing and shall be deposited with the City Clerk.
(C) Powers and duties. The Commission shall have the following duties and responsibilities:
(1) To promote the comfortable use and enjoyment of the golf course for the residents of the city and the general public;
(2) To recommend rules, regulations, general maintenance and usage fees consistent with the overall maintenance and operation of a quality golf course at minimum expense to the city;
(3) To recommend general capital improvements to the golf course and methods to finance the improvements;
(4) To negotiate general operations and management agreements for the golf course, or amendments to existing agreements, providing all agreements shall be subject to acceptance by the Mayor and City Council;
(5) To supervise the performance of any operations and management agreements, including a monthly on-site performance audit when the golf course is open. The audit shall include a review of receipts and expenditures and shall be reduced to writing and signed by the contract manager and City Superintendent of Public Works and deposited with the City Clerk; and
(6) To address grievances by users of the golf course, or residents of the city, concerning the general operations of the golf course and, when appropriate, to resolve or recommend a resolution of the grievance.
(D) Budget. It shall be the duty of the Commission to compile and prepare the preliminary budget for consideration by the Mayor and Council not later than July 1 each year.
