§ 51.123 EFFECTIVE DATE.
   The rates and charges as herein set forth shall become effective on the first full billing period occurring after the adoption of this subchapter.

§ 51.124 SPECIAL RATE CONTRACTS.
   The Board is hereby further authorized to enter into special rate contracts with customers of the sewage works where clearly definable reductions in cost to the sewage works can be determined, and such reduction shall be limited to such reduced costs. Such proposed contracts shall be subject to the approval of the Common Council of the City.

§ 51.998 VIOLATIONS.
   (A)   Any person found to be violating any provision of §§ 51.001 through 51.006, 51.008, 51.020 through 51.027, 51.040 through 51.050, 51.060 through 51.067 and 51.080 through 51.088, shall be served by the city with written notice stating the nature of the violation and providing a reasonable time limit for the satisfactory correction thereof. The offender shall within the period of time stated in such notice, permanently cease all violations.
   (B)   Any person violating any of the provisions of this chapter shall become liable to the city for any expense, loss or damage occasioned by the city by reason of such violation.

§ 51.999 PENALTY.
   (A)   Any person, firm, or corporation who violates any provision of this code for which another penalty is not specifically provided shall, upon conviction, be subject to a fine of $1,000 per day, per violation, in accordance with 40 C.F.R. 403.8(f)(l)(vi)(A), but no more than $2,500 per day, per violation for a first violation nor more than $7,500 per day, per violation for subsequent violations, in accordance with IC 36-l-3-8(a)(10)(B). A separate offense shall be deemed committed upon each day during which a violation occurs or continues.
   (B)   In addition to the civil penalties set forth herein, any person, firm, or corporation who violates any provision of this code shall also be subject to any injunctive relief available to the city, and any applicable criminal sanctions. Each day in which any violation continues beyond the time limit provided for in § 51.998 shall be deemed a separate offense.
