(A) Refuse and litter must be placed in covered, watertight waste containers at all times. For the purpose of this section,
LITTER and REFUSE shall include garbage, waste, peelings of vegetables or fruits, rubbish, ashes, cans, bottles, wire, paper, cartons, boxes, or other materials of an unsightly or unsanitary nature. Any appropriately maintained composting system not exceeding two cubic yards shall be exempt from the restrictions listed in this section. Recyclable materials which are accepted for recycling by the city's recycling contractor, and which are placed in an approved recycling bin or other container provided by the city or its contractor, are exempt. Provided, however, that the recyclable materials placed in such containers must be appropriately placed so as not to cause litter or refuse by overflowing or being blown about from such container.
(B) Any containers, including recycling containers, or other refuse or litter placed at the curb for pickup by any solid waste contractor shall not be placed at the curb earlier than 5:00 p.m. the day before such pickup is scheduled, and any containers must be removed from the curb by 9:00 p.m. the day of pickup.
(C) Penalty. Any violation of the provisions of this section shall be punishable as a minor misdemeanor. Each day a violation occurs shall constitute a separate criminal offense.
