§ 15.30.430 EVALUATION OF DEPARTMENT OF CONSERVATION COMMENTS.
   (A)   The Department of Conservation shall have 30 days from its receipt of a reclamation plan to prepare comments if it so chooses. The Public Works Department shall prepare a written response to any comments received from the Department of Conservation. Such written response shall describe the disposition of the major issues raised by the Department of Conservation. Additionally, if the Public Works Department's position is at variance with any of the recommendations made or objections raised in the Department of Conservation's comments, then the written response shall address, in detail, why specific comments and suggestions were not accepted.
   (B)   The Public Works Department shall forward to the surface mining operator copies of any written responses received from the Department of Conservation, as well as the responses prepared by the Public Works Department.
