Ordinary and customary noises accompanying the following activities shall be exempted from the provisions of this chapter:
(A) Sound emitted from sirens of authorized emergency, police or fire department vehicles.
(B) Operation of lawn mowers, garden tractors, yard trimming devices, and home power tools and equipment when properly muffled, between the hours of 8:00 a.m. and 8:00 p.m.
(C) Burglar alarms or other warning devices when properly installed on publicly or privately owned property, provided any setting off of such alarm or warning device is not intentional (unless for testing purposes) and is investigated and turned off within a reasonable period of time.
(D) Celebrations on Halloween, Independence Day, and other legal holidays.
(E) Permitted parades or festivals, between the hours of 8:00 a.m. and 12:00 midnight, Sunday through Thursday; and between 8:00 a.m. and 1:00 a.m. Friday through Saturday.
(F) Noise connected with athletic and sporting events, concerts, and practices related to them.
(G) The emission of sound for the purposes of alerting persons to the existence of an emergency, or for the performance of emergency work.
(H) Conduct of a legally established and located non-transient business when such sounds are not unreasonably louder than the ordinary and customary noises accompanying such business.
(I) In the case of motor vehicles, where the noise, otherwise in violation of this chapter, is the result of a defective exhaust system, if the cause is repaired or otherwise remedied within seven calendar days of the date the excessive noise first occurred.
(J) Political speech and sound and other speech that is protected under the First Amendment to the Constitution of the United States and/or Article 1, Section 9 of the Indiana Constitution.
(K) Carillons or church or school bells when the bells are used to announce services or used to serve other institutional purposes.
(1) Auctions of property as long as such auctions do not exceed one day’s duration.
(M) Officially authorized motor vehicle events such as demolition derbies and tractor pulls, as long as they are conducted between the hours of 8:00 a.m. and 12:00 midnight.
