§ 153.09 REFILLING OF OPENING OR EXCAVATION; RESTORATION OF SURFACE.
   (A)   Any person who shall open or excavate any street in the township between April 1 and July 31 of the year in which the excavation is made shall thoroughly and completely refill the opening or excavation in such a manner as to prevent any settling thereafter, and shall restore the surface in accordance with §§ 153.20 and 153.21 and in accordance with the specifications of the state’s Department of Transportation which are hereby adopted as specifications of the township for restoration of surfaces of streets in the township.
   (B)   Any person who shall open or excavate any street in the township on or after August 1 of the year in which the excavation is made shall thoroughly and completely refill the opening or excavation in such a manner as to prevent any settling thereafter, and shall restore the surface in accordance with §§ 153.20 and 153.22 and in accordance with the specifications of the state’s Department of Transportation which are hereby adopted as specifications of the township for restoration of surfaces of streets in the township. By December 1 of the year in which the excavation is made, the surface shall be restored in accordance with § 153.22. After March 31 and before August 1 of the following year in which the excavation is made, the surface shall be restored in accordance with § 153.20.
   (C)   The restoration shall be completed before December 1 of the year in which the excavation is made.
   (D)   As restored, the surface shall conform to the proper grade and be of the same surface covering as the part of the thoroughfare immediately adjoining the opening. If within two years after the restoration of the surface as herein provided, defects shall appear therein resulting from defective backfilling by the applicant, the applicant shall reimburse the township for the cost of all necessary repairs to the permanent paving.
