ADOPTING ORDINANCE
ORDINANCE NO. 2021-2
AN ORDINANCE OF MONROE TOWNSHIP, SNYDER COUNTY, PENNSYLVANIA, ENACTING A CODE OF ORDINANCES WHICH RESTATES, COMPILES, AND CODIFIES THE EXISTING ORDINANCES OF MONROE TOWNSHIP.
   WHEREAS, the Board of Supervisors of the Township of Monroe is empowered by the Second Class Township Code, §1506 to pass ordinances necessary for the proper management, care and control of the Township and its finances and the maintenance of peace, good government, health and welfare of the Township and its citizens, trade, commerce and manufacturers; and
   WHEREAS, the present general ordinances of Monroe Township are inadequately arranged and classified and are insufficient in form and substance for the complete preservation of the Township’s ordinances and the maintenance of peace, good government, health and welfare of the Township and its citizens, trade, commerce and manufacturers; and
   WHEREAS, the Second Class Township Code authorizes a general compilation, revision and codification of the ordinances of the Township of Monroe of a general and permanent nature and publication of such ordinance in book form; and
   WHEREAS, this codification is necessary to provide for the usual daily operation of the Township and for the immediate preservation of the public peace, health, safety and general welfare of the Township of Monroe.
   NOW, THEREFORE, it is hereby ordained and enacted by the Board of Supervisors of the Township of Monroe as follows:
   Section 1. The general ordinances of the Township of Monroe as restated, codified, and compiled in book form are hereby adopted as and shall constitute the “Code of Ordinances of the Township of Monroe, Snyder County, Pennsylvania.”
   Section 2. Such Code of Ordinances as adopted in Section 1 shall consist of the following Titles:

   Section 3. All prior ordinances pertaining to the subjects treated in such Code of Ordinances shall be deemed repealed from and after the effective date of this ordinance except as they are included and reordained in whole or in part in such Code; provided, such repeal shall not affect any offense committed or penalty incurred or any right established prior to the effective date of this ordinance, nor shall such repeal affect the provisions of ordinances levying taxes, appropriating money, annexing or detaching territory, establishing franchises, or granting special rights to certain persons, authorizing public improvements, authorizing the issuance of bonds or borrowing of money, authorizing the purchase or sale of real or personal property, granting or accepting easements, plat or dedication of land to public use, vacating or setting the boundaries of streets or other public places; nor shall such repeal affect any other ordinance of a temporary or special nature or pertaining to subjects not contained in or covered by the Code.
   Section 4. Such Code shall be deemed published as of the day of its adoption and approval by the Legislative Authority and the Secretary of the Township of Monroe is hereby authorized and ordered to file a copy of such Ordinance in the Code of Ordinances in the Office of the Township of Monroe.
   Section 5. Such Code shall be in full force and effect as provided in Section 9, and such Code shall be presumptive evidence in all courts and places of the ordinance and all provisions, sections, penalties and regulations therein contained and of the date of passage, and that the same is properly signed, attested, recorded, and approved and that any public hearings and notices thereof as required by law have been given.
   Section 6. All ordinances of a general and permanent nature adopted subsequent to the date in Section 9, and/or prior to the date of adoption of this Ordinance are hereby deemed to be a part of the Code and shall, upon being printed, be included therein. Certified copies of all such ordinances shall be temporarily placed in the Code until printed supplements are included.
   Section 7. It shall be the Township Secretary or someone authorized and directed by the Secretary to keep up-to-date the certified copies of the book containing the Code required to be filed in the office of the Township Secretary for the use of the public. All changes in said Code and all ordinances and resolutions adopted by the Township Board of Supervisors subsequent to the effective date of this codification which the Township Board of Supervisors shall adopt specifically as part of the Code shall, when finally adopted, be included therein by reference until such changes or new ordinances or resolutions are printed as supplements to said Code books, at which time such supplements shall be inserted therein.
   Section 8. All ordinances or parts of ordinances insofar as they are inconsistent herewith are hereby repealed.
   Section 9. All provisions of this Ordinance and of the Code shall be in full force and effect on and after February 23, 2021.
