§ 51.055 HUMMELS WHARF SEWER DISTRICT NO. 2.
   (A)   (1)   The Township Supervisors, pursuant to § 1508 of the Second Class Township Law, being 53 P.S. §§ 65101 et seq., as amended, do hereby constitute the following described portion of the township to be Hummels Wharf Sewer District No. 2, being the territory to be accommodated by the system of sewers to be constructed by Hummels Wharf Municipal Authority, or if already constructed, to be incorporated into the system of sewers presently constructed and operated by Hummels Wharf Municipal Authority.
      (2)   All that area situated in the township, being more particularly bounded and described as follows, to wit:
            Beginning at the northwest corner of Hummels Wharf Sewer District as now established where it intersects the Shamokin Dam Borough line; thence northwardly to the northwest corner of Shamokin Dam Borough; thence in a westerly direction, at almost a 90 degree left angle to a point where L.R. 54045 intersects with Township Road T-506, known as Fisher Road; thence along L.R. 54045 to a point where L.R. 54045 intersects with Township Road T-495, known as Inch Road; thence along unopened T-495 to Township Road T-504, known as Penn’s Drive, and continuing from there in a straight line to the low water mark of Penn’s Creek; thence southwardly along the low water mark of Penn’s Creek along its many courses to the south boundary line of the township which divides Monroe and Penn Townships; thence along said boundary line in a south easterly direction to the low water mark at the west bank of the Susquehanna River; thence northwardly along the low water mark of the west bank of the Susquehanna River along its several courses to the southeast corner of Hummels Wharf Sewer District as now established; thence northwestwardly along the said Hummels Wharf Sewer District to the southwest corner of said Sewer District; thence northwestwardly along the west boundary line of the present Hummels Wharf Sewer District to the northwest corner of said District, the place of beginning.
   (B)   Hummels Wharf Municipal Authority is hereby authorized to construct a system of sewers and/or take over a system of sewers already constructed in the said area and to finance the cost of any construction undertaken by Hummels Wharf Municipal Authority under the provisions of the Municipal Authorities Act of 1945, being 53 Pa.C.S. §§ 5601 et seq., as amended.
   (C)   (1)   As required by § 1502 of the Second Class Township Law, as amended, this section authorizing the establishment and construction of said system of sewers in said Sewer District No. 2 by Hummels Wharf Municipal Authority, shall be advertised in the Selinsgrove Times-Tribune, a newspaper of general circulation published in the county, once a week for three successive weeks.
      (2)   If, before the expiration of 20 days after the last publication, 60% of the total property owners of the affected sewer district, shall sign and file, in the office of the Prothonotary of the County Court of Common Pleas, a written protest against the construction of or taking over of a system of sewers already constructed in said District, then the construction and/or take over authorized by such resolution shall not be undertaken or proceeded with.
