§ 36.42 DEFINITIONS.
   DANGEROUS MATERIAL. Explosives or containers used in the holding or transporting of explosives.
   LAND CLEARING. The uprooting or clearing of vegetation in connection with the construction of buildings, right of way, agricultural, residential, commercial, or industrial development, mining activities, or the initial clearing of vegetation to enhance property value; but does not include routine maintenance or property cleanup activities.
   OPEN BURNING. The burning of any matter in such a manner that the products of combustion resulting from the burning are emitted directly into the atmosphere without passing through a stack, chimney, or a permitted air pollution device. For purposes of this section, open burning does not include cooking devices such as charcoal grills, gas grills, camp stoves, and other similar devices used for home cooking purposes.
   OZONE ACTION DAYS. Days that the North Carolina Department of Environment and Natural Resources, Division of Air Quality, has issued an ozone forecast of code orange, code red, or code purple for the Charlotte region.
   PUBLIC ROADWAY. Any City street, road, alley, or right-of-way dedicated or maintained for public use including streets or roads which are part of the North Carolina highway system.
   RESPONSIBLE PARTY. The person in operational control over the open burning, or the land owner or the person in possession or control of the land when he has directly or indirectly allowed the open burning or has benefited from it.
