Since the town or the county do not have a riverboat whereby it may collect riverboat gaming tax and since I.C. 4-33-13-6 requires the state to distribute wagering taxes to the County Treasurer who is required to place distributions in the city or town’s General Fund or Riverboat Fund, or both, authorizes the creation of a Riverboat Gaming Fund as long as the funding is forthcoming to be used as designated through appropriation by the town’s fiscal body.
