(a) Unreasonable Noise. No person shall generate or permit to be generated in or on a motor vehicle or otherwise, unreasonable noise or loud sound by means of a radio, tape player, compact disc player, phonograph, television, loudspeaker or any other sound amplifying device on a street, highway or in the public right of way where the sound is audible 100 feet from the device amplifying the sound.
(b) Exemptions. Warning and alarm devices which have the purpose of signaling unsafe or dangerous situations or calling for police, or warning devices on emergency and public safety vehicles, shall be exempt from the prohibitions of this section, when such devices are used for such purposes.
(c) Penalty. Whoever violates subsection (a) hereof is guilty of generating unreasonable noise, a minor misdemeanor. If the offender persists in generating, or permitting to be generated, unreasonable noise after a reasonable warning or request to desist, than generating unreasonable noise is a misdemeanor of the fourth degree.
Upon a conviction of a second violation or subsequent violation of this section, both the sound equipment and any motor vehicle involved shall be deemed to be contraband and subject to seizure and forfeiture under Ohio R.C. 2933.41 through 2933.43, unless and until the offender has removed the sound equipment from the motor vehicle within fifteen days of said conviction, in which event the motor vehicle shall be returned to the offender and the sound equipment shall remain subject to the provisions of Ohio R.C. 2933.41 through 2933.43.
