337.31 PROHIBITING THE USE OF ANY ENGINE BRAKE.
   (a)   For purposes of this section, the term “Engine Brake” shall mean an engine brake or a similar device, which mounts on a motor vehicle engine, changes the action of the exhaust valves, and provides retarding power which is proportional to the engine’s Revolutions Per Minute (RPM) so as to slow the motor vehicle.
   (b)   No person while operating a motor vehicle within the Village of Minerva shall activate any Engine Brake on any motor vehicle unless the other braking devices on such motor vehicle have failed or exigent circumstances exist which require the use of such “Engine Brake.”
   (c)   Whoever is found guilty of violating this ordinance shall be guilty of a minor misdemeanor and shall be fined not more than one hundred dollars ($100.00).
