121.01 DISPOSITION OF PROPERTY UNNEEDED, OBSOLETE OR UNFIT FOR MUNICIPAL USE.
   This Policy for Disposition of Property Unneeded, Obsolete or Unfit for Municipal Use applies to all offices, departments, officials and employees of the Village of Minerva. All property that is unneeded, obsolete or unfit for municipal purposes from any office or department of the Village shall be reported to the Village Administrator for disposition pursuant to the terms of this policy. No other department, official or employee of the Village shall dispose of property other than the Village Administrator, under the following guidance.
   (a)   Property Determined to Have No Value. If Council determines that the property is not needed for public use, or is obsolete or unfit for public use, and that the property has no value, Council may, by motion, authorize the Village Administrator to discard or salvage the property.
   (b)   Property With Estimated Value less than One Thousand Dollars. If Council determines that the property is not needed for public use, or is obsolete or unfit for public use, and that the estimated value of the property is less than one thousand dollars ($1,000.00), Council may, by motion, authorize the Village Administrator to sell the property without advertising or bids.
   (c)   Property With Estimated Value of One thousand Dollars or More. If Council determines that the property is not needed for public use, or is obsolete or unfit for public use, and that the estimated value of the property is one thousand dollars ($1,000.00) or more, Council may, by motion, authorize the Village Administrator to advertise for bids to sell the property. The Village Administrator shall then advertise the property for sale for not less than two nor more than four weeks in a newspaper of general circulation within the Village of Minerva, or as provided in Ohio Revised Code Section 7.16. After bid opening, the property shall be sold only when authorized by Council by Ordinance with the highest and best bidder. Council reserves the right to reject all bids.
   (d)   Trade-in of Property is Authorized. When Council finds that the Village has vehicles, equipment or machinery which is obsolete or is not needed or unfit for public use, and that the Village needs to replace the property, and that it will be in the best interest of the Village that the property be traded-in, Council may, by motion, authorize the Village Administrator to advertise for bids to purchase property subject to trade-in of the Village owned vehicles, equipment or machinery. After bid opening, the property shall be purchased only when authorized by Council by Ordinance with the lowest and best bidder. Council reserves the right to reject all bids.
   (e)   Sale by Internet Auction. Notwithstanding anything to the contrary hereinabove, Council for the Village may sell property that is obsolete or is not needed or unfit for public use by internet auction, in compliance with the requirements of Ohio Revised Code Section 721.15(D).
