153.09 REMOVAL OF DANGEROUS TREES ON PRIVATE PROPERTY.
   Trees on private property that are dead, diseased or otherwise in a condition that, in the opinion of the Shade Tree Commission, constitute a hazard to life or property or harbor insects or disease which constitutes a potential threat to other trees within the Municipality shall be removed by the owner of the property on which such trees stand within ten days of receipt of written notice from the Shade Tree Commission. Upon the neglect or refusal of such property owner to remove any such tree within ten days of receipt of written notice, the Administrator shall have any such tree removed, at the expense of the property owner. Such expense shall be certified to the Auditor of the County wherein such property is situated for collection. The remedy provided for herein is in addition to the penalty provided in Section 153.99.
