1339.02 PERMIT REQUIRED; APPLICATION; FEE; INSPECTION.
   (a)   Permit Requirements. No person, firm or corporation shall erect or cause to erect a fence without a permit. Installation or erection of a fence shall not commence before such permit is issued. Hedges shall be exempt from permits, but shall comply with all other requirements of this chapter.
 
   (b)   Permit Application. The owner or occupant of any lot or parcel of land in the Village who desires to construct or erect a fence at any location within the Village shall obtain a permit from the Office of the Clerk of Council. Prior to obtaining a permit, the applicant shall submit the following information.
      (1)   A plan showing the dimensions of the lot on which the fence is to be constructed. Such drawing shall show adjacent streets, buildings or other structures and overhead facilities. The drawing shall show the exact location of the fence, its height, length and type of materials used in the construction and method of installation.
      (2)   Written consent of the owner of the property on which the fence will be erected, if not the same as applicant.
      (3)   Written consent of adjacent owners of property if the fence is to be erected on the property line.
 
   (c)   Permit Fee. The application fee for each fence permit shall be ten dollars ($10.00). When any fence is erected on any property prior to obtaining a permit, the fee shall be two times the specified fee. However, the payment of this penalty fee shall not relieve any persons from complying with any of the requirements of this chapter.
 
   (d)   Permit Expiration. A fence permit shall become void if the work for which the permit was issued has not been completed within six months after the date the permit was first issued.
 
   (e)   Inspection. Fences shall not encroach upon another lot or parcel of land. The Village shall inspect installations to determine that the fence is constructed in accordance with plans submitted for the permit. However, the issuance of the permit by the Village does not mean that the Village has determined that the fence is not encroaching upon another lot. If there is any doubt, the Village may request a survey of the property lines at the expense of the person seeking the permit.
