(a) All in ground pools shall be completely enclosed by a fence erected along the periphery of the pool. Said fence shall be no less than four feet in height and not over seven feet above ground level and shall conform to the standards as set forth within Chapter 1339 of Minerva Codified Ordinances. A building or existing wall may be used as part of the fence enclosure.
(b) All fence openings to the pool area enclosures shall be equipped with a self- closing, latching gate. The fence and gate shall not be less than four feet nor over seven feet in height above ground level and shall be locked when the pool is not in use or is left unattended.
(c) Above ground pools with a wall height of four feet or greater measured from the surrounding grade where the pool wall is used as a barrier shall not require a fence. However the ladder or steps shall be capable of being secured, locked or removed to prevent access when the pool is not in use, or the ladder or steps shall be surrounded by a fence with a locking gate not less than 4 feet in height.
(d) All pools shall be constructed or installed so that the drainage shall not be a nuisance to adjacent property owners. All pools shall be properly maintained, kept clean and in sanitary condition. No pool shall be located a distance less than seven feet from any side or rear property line. Pools are not permitted to be installed in any front or side yard.
