921.99 EQUITABLE REMEDIES; PENALTY.
   (a)    If any person or industrial user discharges sewage, industrial wastes or other wastes into the POTW contrary to the substantive provisions of this chapter or of any order of the Service Director, the Village Solicitor shall commence an action for appropriate legal and/or equitable relief in a court of competent jurisdiction.
   (b)    Whenever the Service Director finds that any industrial user has violated, or is violating any of the provisions of this chapter, or has or is engaged in conduct which justifies revocation of an industrial waste permit or suspension of service, the Service Director may petition the Court for the issuance of a preliminary or permanent injunction, or both, to restrain or compel activities on the part of the industrial user.
   (c)   Any person who knowingly makes any false statements, representations or certifications in any application, record, plan or other document filed or required to be maintained pursuant to this chapter, or who falsifies, tampers with, or knowingly renders inaccurate any monitoring device or method required by these regulations, shall be fined not more than one thousand dollars ($1,000) or be imprisonment for not more than six months, or both, for each offense. A separate offense shall be deemed committed each day during or on which a violation occurs or continues. (Ord. 21-94. Passed 6-28-94.)
   (d)    When the Authority finds that an Industrial User has violated, or continues to violate, any provisions of this chapter, an individual wastewater discharge permit or order issued hereunder, or any other Pretreatment Standard or Requirement, the Authority may fine such Industrial User in an amount not to exceed five thousand dollars ($5,000) per day per violation. Such fines shall be assessed on a per-violation, per day basis. In the case of monthly or other long-term average discharge limits, fines shall be assessed for each day during the period of violation.

   (e)    Any industrial user who willfully or negligently violates any provision of this chapter, or any orders or permits issued hereunder, shall, upon conviction, be guilty of a misdemeanor, punishable by a fine not to exceed one thousand dollars ($1,000) or imprisonment for not more than one year, or both, for each offense. A separate offense shall be deemed committed each day during or on which a violation occurs or continues.
