921.09 CONTROL OF NONACCEPTABLE WASTES.
   (a)    If any waters or wastes are discharged or are proposed to be discharged to the public sewers, which waters contain the substances or possess the characteristics enumerated in Sections 921.07 and 921.08 and which waters, in the judgment of the Authority, may have a deleterious effect upon the sewage works, processes, equipment or receiving waters, or otherwise create a hazard to life or constitute a public nuisance, the Authority may:
      (1)    Reject the wastes;
      (2)    Require pretreatment prior to discharge to the public sewers in order to eliminate substances prohibited in Section 921.07 and/or to bring the waste within the limitations set forth in Section 921.08 or to modify the character or concentration of the wastes to a level specified by the Service Director, which specification shall be made in light of and based upon an evaluation of the loads upon, conditions of, and capacity of, the system at the time the pretreatment order is issued;
      (3)    Require control over quantities and rates of discharge;
      (4)    Require payment of a surcharge to cover the added cost of handling and treatment of the wastes not covered by existing taxes or sewer charges;
      (5)    Adjust limits of polluting substances discharged to the sewer system when such pollutants prevent the wastewater treatment plant from meeting stream water quality criteria and/or NPDES permit limits required by the Ohio EPA or other governmental body; or
      (6)    Require the installation of grease, oil and fat interceptors when, in the opinion of the Service Director, such devices are necessary for the proper handling of wastes containing grease in amounts above the levels allowed in Section 921.07, flammable wastes, sand and other harmful ingredients.
          A.    Such interceptors shall not be required for private living quarters or dwelling units.
         B.    All interceptors shall be of a type and capacity approved by the Service Director.
         C.    All interceptors shall be located so as to be readily and easily accessible for cleaning and inspection.
         D.    Grease and oil interceptors shall be constructed of impervious materials capable of withstanding abrupt and extreme changes in temperature. They shall be of substantial construction, watertight and equipped with easily removable covers which, when bolted in place, shall be gastight and watertight.
         E.    The cost of purchasing, installing, maintaining and cleaning such devices shall be the responsibility of the owner. Removal and disposal of the captured material shall be the responsibility of the owner.
   (b)    If the Authority permits the pretreatment or equalization of waste flows, the design and installation of the plants and equipment shall be subject to the review and approval of the Authority and subject to the requirements of all applicable Federal, State and local codes, regulations and laws. Where installed, all grease, oil and sand interceptors, flow equalization devices, pretreatment facilities or other wastewater control devices shall be constructed, maintained, repaired and replaced by the owner, at his or her expense and shall be in continuously
efficient operation at all times.
   (c)    No statement contained in this section shall be construed as preventing any special agreement or arrangement between the Authority and any industrial concern whereby an industrial waste of unusual strength or character may be accepted by the Authority for treatment, subject to payment therefor by the industrial concern in proportion to cost and consistent with the user charge system.
