§ 51.85 USER CHARGE.
   (A)   Every person whose premises are served by the Authority will be charged for the sewer services provided. A basic charge based on the water meter readings, or if available, a discharge metering device approved by the Authority, and the basic charges shall be as follows and are levied to defray the cost of operation and maintenance and replacement of the treatment works:
      (1)   Minimum charge. The total minimum rate for customers residing within the corporate limits of the village is $15.79 monthly based upon a minimum usage of 1,700 gallons. The total minimum rate for customers residing outside the corporate limits of the village is $23.69 monthly based upon a minimum usage of 1,700 gallons.
      (2)   Basic user charges. For usage in excess of 1,700 gallons monthly, in addition to the minimum charges above, $9.29 per 1,000 gallons metered shall be the basic rate charge for customers residing within the corporate limits of the village and $13.94 per 1,000 gallons metered shall be the basic rate charge for customers residing outside the corporate limits of the village.
         (a)   Sewer connections only. The minimum charge for users of sewer connections only shall be at the rate of $15.79 monthly for customers residing within the corporate limits of the village and $23.69 monthly for customers residing outside the corporate limits of the village. An additional $9.29 per 1,000 gallons of wastewater discharged into the sewer system in excess of the minimum 1,700 gallons monthly usage shall be charged to customers residing within the corporate limits of the village, and an additional $13.94 per 1,000 gallons of wastewater discharged into the sewer system in excess of the minimum 1,700 gallons monthly usage shall be charged to customers residing outside the corporate limits of the village.
         (b)   Other sewer connections. All charges for use of sewer connections where water is supplied thereto by the Authority subject to the special provisions herein shall be as follows:
            1.   A minimum charge of $15.79 monthly for customers residing within the corporate limits of the village, and $23.69 monthly for customers residing outside the corporate limits of the village, which rates shall apply as a service charge so long as the sewer connection is in service and regardless whether or not water is used during the period, and which minimum charges shall entitle the user to discharge 1,700 gallons of water monthly into the sewer system.
            2.   For all water metered to said premises in excess of the 1,700 gallons, a charge therefor shall be at the rate of $9.29 per 1,000 gallons of water metered for customers residing within the corporate limits of the village, and at the rate of $13.94 per 1,000 gallons of water metered for customers residing outside the corporate limits of the village. The above rates shall apply to the amount of water passing through the water meter except when an approved discharge metering system is utilized. In this case the rates shall apply to that water discharged to the system.
   (B)   Basis of wastewater service charges. The wastewater service charge for the use of and for service supplied by the wastewater facilities of the village shall consist of a basic user charge for operation and maintenance plus replacement.
      (1)   (a)   The basic user charge shall be based on water usage as recorded by water meters and/or sewage meters for wastes having the following normal domestic concentrations:
            1.   A five day, 20° C. biochemical oxygen demand (BOD of 204 mg/l.)
            2.   A suspended solids (SS) content of 260 mg/l.
         (b)   It shall consist of operation and maintenance costs plus replacement and shall be computed as follows:
            1.   Estimate wastewater volume, pounds of SS and pounds of BOD to be treated.
            2.   Estimate the projected annual revenue required to operate and maintain the wastewater facilities including a replacement fund for the year, for all works categories.
            3.   Proportion the estimated O, M and R costs to each user class by volume, suspended solids and BOD.
            4.   Proportion the estimated operation, maintenance and replacement (O, M and R) costs to wastewater facility categories by volume, suspended solids and BOD.
      (2)   Wastewater service charge shall be computed as follows:
         CW = CM + CDM + (Vu-X) Cu + (Vu-X) CUD + CS
         Where:
      CW      =   Amount of waste service charge ($) per billing period.
      CM      =   Minimum charge for Operation, Maintenance and Replacement
      CDM      =   Minimum charge for debt service
      Vu      =   Wastewater Volume for the billing period
      X      =   Allowable consumption in gallons for the minimum charge
      Cu      =   Basic user rate for operation, maintenance and replacement
   (C)   Notification. The users of the wastewater treatment service will be notified annually, in conjunction with a regular bill, of the rate and that portion of the user charges which are attributed to the wastewater treatment operation, maintenance and replacement.
   (D)   Annual review. The adequacy of the wastewater service charge shall be reviewed not less often than annually, by Certificate Public Accountants for the village in their annual audit report. The wastewater service charge shall be revised periodically to reflect a charge in local capital costs including replacement costs.
   (E)   Measurement of flow. The volume of flow used for computing basic user charges shall be the metered water consumption read to the lowest even increments of 100 gallons.
      (1)   If the person discharging wastes into the public sewers procures any part, or all, of his or her water from sources other than the Public Waterworks System, all or a part of which is discharged into the public sewers, the person shall install and maintain, at his or her expense, water meters of a type approved by the village for the purpose of determining the volume of water obtained from these other sources.
      (2)   Devices for measuring the volume of waste discharged may be required by the village if these volumes cannot otherwise be determined from the metered water consumption records.
      (3)   Metering devices for determining the volume of waste shall be installed, owned and maintained by the owner. Following approval and installation, such meters may not be removed, unless service is canceled, without the consent of the village.
   (F)   Automatic increase. In the event that the water supplier for the village raises water rates and charges for the cost and use of water being supplied, then those rates and charges shall be automatically applied to the rates charged by the village to its customers.
   (G)   The rates and charges prescribed in division (A) of this section and its subdivisions shall increase by 4% on January 1, 2020, and shall increase by an additional 2% each year thereafter on January 1, with the final increase to take place on January 1, 2026.
