§ 51.08 SEWAGE DISPOSAL FACILITIES.
   (A)   Every dwelling house, factory or business building in the village fronting on sanitary sewer mains and constructed subsequent to the placing of the sewer mains, shall be furnished by the owner or agent thereof with suitable sanitary toilet facilities properly connected to such sewer service. Where sewer service is not available, all such premises so located shall be furnished with such other types of toilet facilities as may be approved by the Chief of Police or any representative appointed therefor by the President and Board of Trustees.
   (B)   Where outside privies are used, they shall be of approved design and shall be so located that the outside walls thereof shall be at least five feet distant from the line of every adjoining lot, and at least 20 feet from the nearest wall of any house, school, factory or other place of residence or business, and at least ten feet distant from any street, alley or public park, and every owner or agent or person in control of any of such premises who shall violate or fail to comply with any of the provisions of this section shall be deemed guilty of creating and maintaining a nuisance.
   (C)   (1)   No outdoor toilets, privies, cesspools or septic tanks shall be used, maintained or permitted to be used or maintained upon any premises located within the village, excepting the premises hereinafter described and set forth, which are excluded from the application of this section by reason of grade line, namely:
         (a)   All that part of Lot 20, part of the Northwest Quarter of Section 15, lying within the corporate limits of the village.
         (b)   All of Lots 19 to 30, inclusive, of Jos. Kopp's Addition, reference being had to the plat thereof recorded in the Recorder's office of St. Clair County, Illinois in Book of Plats “A” on page 69.
         (c)   All that part of Lot 6, part of the Southwest Quarter of Section 10, lying East of the extension southerly of the centerline of Mulberry Street or South of the extension eastwardly of the centerline of the alley between Lots 13 to 18 inclusive, and Lots 19 to 24, inclusive, of said Jos. Kopp's Addition.
         (d)   All of Lot 8, being part of the Southwest Quarter of Section 10.
         (e)   All that part of Lot 19, part of the Northwest Quarter of Section 13, which lies within the corporate limits line of the village.
         (f)   All of that part of Lot 1, part of the Southwest Quarter of Section 10, lying within the corporate limits line of the village.
         (g)   All that part of Lot 1, part of the Northwest Quarter of Section 15, lying within the corporate limits line of the village.
      (2)   All of the premises being located in Township One South, Range Nine West of the Third Principal Meridian.
